The following terms and conditions, privacy policy and cookie policy cover services that are provided by DKMBA (under D K Music Business Academy Ltd). If you continue to browse and use this website, you are agreeing to comply with and be bound by the following Terms and Conditions. If you disagree with any part of these terms and conditions, please do not use the website.

Membership Options

There are two ways to be a member of DKMBA:

Monthly Academy Member: $19.99 per month (adjusted for your currency)

Pro (Yearly) Academy Member: $199 per year (adjusted for your currency)

Lifetime Membership: Lifetime membership is a special condition only available during specific times of the year. In this case, members pay one single time and have full access to the entire Academy for the duration of the Academy existence. There is no expiration date and no renewals. This option does not include a Free Trial or refunds. Prices for this membership may change from time to time, depending on the promotional action in place, without notice. We reserve the right to modify or discontinue services, products or learning tools without prior notice.

From time to time we may offer discounts on the price of Academy Membership. Prices for our products and services are subject to change without notice. We reserve the right to modify or discontinue services, products or learning tools without prior notice.

Respecting the Children’s Online Privacy Protection Act, we cannot allow children under the age of 13 to open an account with DKMBA. Children between the ages of 13 and 18 must have a parent or guardian present when using DKMBA.

Information and Disclaimers

The material on this website is owned by or licensed to DKMBA and includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction of all material is prohibited other than in accordance with the copyright notice and with permission given.

DKMBA will not be held liable in connection to the website, products or services offered both by us or others. This includes direct, indirect or consequential losses. By accepting these terms and conditions you accept that DK MBA is not responsible for the welfare of subscription holders.

Rights

DKMBA reserves the right to change or alter any part of the website, with or without notice, both temporarily and permanently. We always work to maintain the website at all times, however, it is subject to change. Any content posted within the website and its corresponding Facebook group, is able to be used in any DKMBA marketing and promotional material.

This website may also include links to other websites or applications. These links are provided for the user’s convenience to give further information. They do not signify that DKMBA agrees or endorses them and is not liable for their content.

Pricing

Payments between DKMBA and users are handled by Stripe Inc. All prices on the website are correct at the time of writing and are subject to change at any time before an agreement is made; once an agreement is made between DKMBA and a user the price is fixed unless stated. If you sign up for a Pro Subscription but you have insufficient funds, you will be downgraded to a Monthly subscription and given the opportunity to come back to Pro.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

Payments and Membership Cancellation

You are entitled to cancel your membership at any point with DKMBA, but please read below for full terms and conditions. DKMBA is also entitled to cancel your membership at any time with a full refund.

Your subscription will automatically renew unless and until you cancel your subscription or if your subscription is suspended or removed by DKMBA for breach of rules. By submitting your credit card, debit card, or PayPal information, and associating that information with your DKMBA account, you authorise DKMBA to process your purchase accordingly. If you purchase a monthly or yearly subscription for a product or service, you understand and authorise DKMBA to automatically renew your subscription until cancelled. You can easily and quickly cancel your subscription by contacting us at [email protected].

If you wish to cancel your membership, you need to email [email protected] with your full name and email address you signed up with and the next payment will be cancelled upon receipt of this email, within a 7 Day Period. You must make contact before the payment is taken for the next month in order to avoid being charged. As long as you send an email before payment is taken, you will not have to pay for the next billed month. Sometimes there are exceptions where we aren't able to reply to your email in time for the billing to be cancelled and in this case, we refund you for the payment taken.

Annual/Pro Payments After Year 1

For recurring Annual/Pro payments, after one year minimum as a member, you're entitled to a refund if you email [email protected] within 14 days of your charge (renewals only). If it is outside of 14 days then the refund cannot be granted.

Moving Plans

It is possible to move from Monthly payments to Annual payments. It is possible to move from Annual to Monthly payments, but only after one full year has occurred, as payments are not refundable.

We provide support free of charge by emailing us at [email protected]. Our customer support team will usually respond to queries and issues swiftly.

Please note that DKMBA is a web-delivered service and in order to access it effectively, you will need to possess a suitable device with a modern browser installed and a fast Internet connection. We cannot support every version of every browser.

Success Guarantee

We have a success guarantee where you will achieve 5000 organic streams within 1 year of joining across all of your music (not just a single song or a single platform). In order to be entitled for a refund and another course purchase, you need to have done the following:

- Watched every course in it's entirety.

- Been present for a minimum of 20 live sessions

- Joined the community and been an active member (a minimum of 20 unique posts over the course of a year)

- Implemented specific changes suggested in socials from Damian to a high standard.

- Not paid for any bots on any platform at any point.

- In reference to "pay for you to do another course up to $1000" claim, this doesn't mean you receive this amount but can select a course worth up to this amount.

DKMBA/Damian Keyes are not responsible for your well-being or your income.

Limitation of Liability

In no event shall DKMBA be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including, without limitation, lost profit damages arising from: (a) your use or inability to use the DKMBA educational products and services, learning tools, and self-publishing tools, or linked services, or the performance of the DKMBA educational products and services, learning tools, and self-publishing tools, or linked services, (b) any action taken in connection with an investigation by DKMBA or law enforcement authorities regarding your access to or use of the DKMBA services, (c) any action taken in connection with copyright or other intellectual property owners or other rights owners, (d) any errors or omissions in the DKMBA services' technical operation, or (e) any damage to a user's computer, hardware, software, modem, or other equipment or technology, including damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line, or network failure or any other technical or other malfunction, including losses or damages in the form of lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or equipment failure or malfunction. notwithstanding anything to the contrary contained herein, DKMBA's liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to DKMBA for the DKMBA services during the term of membership. the foregoing limitations of liability will apply even if any of the foregoing events or circumstances were foreseeable and even if DKMBA was advised of or should have known of the possibility of such losses or damages, regardless of whether you bring an action based in contract, negligence, strict liability, or tort (including whether caused, in whole or in part, by negligence, acts of god, telecommunications failure, or destruction of the DKMBA educational products and services, learning tools, and self-publishing tools.
